Terms and Conditions of Sale

1. General

These Terms and Conditions (“Terms”) apply to all quotations, sales, and supply of products and services (“Products”) by Fineline Systems (“the Company”, “we”, “our”, or “us”) to any person, builder, developer, or entity (“the Customer”, “you”). By placing an order, paying a deposit, or accepting delivery, you agree to be bound by these Terms.

2. Quotations and Orders

  • All quotations are valid for 30 days unless otherwise stated.
  • Orders are accepted upon written confirmation and payment of any required deposit, or payment in full.
  • Variations or cancellations after acceptance may incur additional charges for materials, labour, or administration.
  • The Company reserves the right to correct typographical or clerical errors in quotes or invoices.

3. Pricing and Payment

  • All prices are in Australian dollars and exclude GST unless stated otherwise.
  • We accept payment through third-party payment gateway company www.woocommerce.com. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.
  • GST will be included in the price of purchases. We may change prices at any time. All payments shall be in Australian Dollar (AUD).
  • We reserve the right to refuse, limit or cancel any order placed through the Services.
  • A deposit (typically 50%) is required to confirm a commercial order, with the balance due prior to delivery.
  • Ownership of Products remains with the Company until full payment is received.
  • Overdue accounts may attract interest at 7% per month and recovery costs may be charged to the Customer.

4. Delivery and Installation

  • Delivery dates are estimates only. The Company will not be liable for delays due to manufacturing, supply chain issues, weather, or site conditions.
  • The Customer must ensure that the site is ready, accessible, and safe for delivery or installation.
  • Risk passes to the Customer upon delivery or collection.
  • Fineline Systems does not offer installation services.

5. Specifications and Product Variations

  • All Products are custom-made based on approved drawings, measurements, or specifications supplied by the Customer.
  • It is the Customer’s responsibility to check and confirm all details before placing an order.
  • The Company reserves the right to make design or material changes where necessary to meet compliance, performance, or safety requirements.

6. Warranty

Our Products are covered by a Manufacturer’s Warranty against defects in materials and workmanship. Warranty periods vary by component (e.g. frames, glass, hardware) and are outlined in our Warranty Statement.

This warranty is in addition to your rights under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and to have the goods repaired or replaced if they fail to be of acceptable quality.

The warranty does not cover damage from misuse, improper installation, or lack of maintenance.

7. Returns and Cancellations

  • As our products are custom-made, returns or cancellations are not accepted once manufacturing has commenced. Please refer to our Returns Policy for more information.
  • All cancellations must be made in writing and approved by the Company.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Company’s total liability is limited to the replacement, repair, or refund of the defective Product.
  • The Company is not liable for indirect, consequential, or financial loss (including delay costs, loss of profit, or damage to property).
  • Installation work by third parties is outside the Company’s responsibility.

9. Customer Responsibilities

The Customer must:

  • Ensure accurate measurements and specifications are provided.
  • Obtain any necessary approvals, permits, or compliance certifications.
  • Maintain Products in accordance with our Care & Maintenance Guide.
  • Notify the Company promptly of any defects or issues.

10. Force Majeure

The Company is not liable for failure to perform obligations due to events beyond its reasonable control, including natural disasters, pandemics, industrial disputes, or transport delays.

11. Intellectual Property

All drawings, designs, and technical documents remain the property of the Company and must not be copied, shared, or used without written consent.

12. Governing Law

These Terms are governed by the laws of the State of NSW, Australia. Any disputes will be handled in the courts of that State.
